1) Agreement
By accessing or using NewsPlay — including the website at newsplays.com and the NewsPlay apps on Apple TV (tvOS) and iOS (collectively, the “Service”) — you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
The Service is operated by Northover Media, Inc., a corporation incorporated in the State of Delaware, United States, with operations in Perth, Western Australia, Australia. These Terms are primarily governed by U.S. law.
2) What We Do
NewsPlay provides a cable-style interface for discovering and accessing live news and factual streams aggregated from publicly available broadcaster CDNs and third-party platforms. We act as an aggregator only. We do not host, produce, or control the underlying streams. Stream availability, quality, and content may change at any time without notice and are outside our control.
3) The Apps
The NewsPlay Apple TV and iOS apps are published on the Apple App Store by Northover Media, Inc. The Apple TV app is free with no in-app purchases. The iOS app functions as a companion to newsplays.com. Your use of the apps is also subject to Apple’s App Store Terms of Service. In the event of any conflict between these Terms and Apple’s terms, Apple’s terms govern with respect to App Store distribution only.
4) Your Account
Certain features of the Service require an account. If you register, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or our policies.
5) Acceptable Use
You agree not to:
- Record, download, capture, or restream any content from the Service
- Circumvent, disable, or interfere with any content protection, player restriction, or access control
- Infringe any third-party intellectual property, privacy, or publicity rights
- Use the Service for any unlawful purpose or in violation of any applicable federal, state, or local law or regulation
- Interfere with or disrupt the Service, its servers, or networks
- Attempt to access non-public areas of the Service or its infrastructure
- Introduce malware, viruses, harmful code, or automated scrapers or bots
- Misrepresent your identity or affiliation in connection with the Service
6) Intellectual Property
- The NewsPlay brand, interface, design, and original content are owned by Northover Media, Inc. and are protected by U.S. and international intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes only.
- All video content, logos, channel names, and trademarks displayed within the Service belong to their respective owners and are not licensed to you by Northover Media, Inc.
- Embedded or aggregated streams are accessed under the terms of the originating platforms (e.g., YouTube Terms of Service, broadcaster distribution terms).
7) Third-Party Content and Services
The Service aggregates, links to, and embeds content and streams from third-party broadcasters, CDNs, and platforms. We are not responsible for the content, accuracy, availability, policies, or terms of those third parties. Access to third-party content through the Service does not imply endorsement by Northover Media, Inc.
8) Advertising and Sponsorships
We may display advertising or sponsorship content within the Service interface. Sponsored placements will be clearly identified. We do not insert advertising into or over third-party broadcast streams.
9) Disclaimers and Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Any stream or channel will be available at any particular time
- The Service will meet your requirements or expectations
Australian Consumer Law: Nothing in these Terms excludes or limits any consumer guarantee or statutory right that cannot lawfully be excluded or modified under the Australian Consumer Law.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NORTHOVER MEDIA, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
11) Indemnification
You agree to indemnify, defend, and hold harmless Northover Media, Inc. and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Service.
12) Digital Millennium Copyright Act (DMCA)
If you believe that content accessible through the Service infringes your copyright, please submit a notice to info@newsplay.co including:
- Your name and contact information
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material and its location on the Service
- A statement that you have a good-faith belief that the use is not authorised
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf
- Your physical or electronic signature
We will respond to valid DMCA notices in accordance with applicable law.
13) Modifications, Suspension, and Termination
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We may update these Terms from time to time; material changes will be communicated by updating the “Last updated” date and, where appropriate, by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
We may suspend or terminate your access to the Service at any time for violation of these Terms, for conduct we deem harmful to the Service or other users, or for any other reason at our sole discretion.
14) Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
For U.S. users: Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. The arbitration shall take place in Delaware, USA. You and Northover Media, Inc. waive the right to a jury trial and to participate in a class action.
For international users: You consent to the exclusive jurisdiction of the courts of the State of Delaware, United States, for any disputes not subject to arbitration.
Australian users: Nothing in this clause limits any rights you may have under the Australian Consumer Law that cannot be excluded by contract.
15) General Provisions
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Northover Media, Inc. with respect to the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
- No Agency: Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Northover Media, Inc.
